There are several physical and mental medical conditions that can
trigger a California DMV medical driver’s license suspension.
Epilepsy, certain mental health conditions, physical disabilities,
vision problems, any condition that causes loss of consciousness,
and even age can prompt a California
Department of Motor Vehicles medical suspension.
However, a medical suspension isn’t automatic – the
driver is entitled to a hearing and can be represented by an attorney who will present evidence
on his or her behalf. The experienced DMV lawyers of The Kavinoky
Law Firm are skilled in every aspect of medical
suspension hearings, and will fight hard to protect the driver’s
license and freedom.
Medical suspensions occur when the California Department of Motor Vehicles receives information about a condition that affects an individual’s ability to safely operate a motor vehicle. The information can come from a doctor, a police officer, a family member, or any other reliable source. Once the DMV has been informed of a medical condition that may affect driving ability, the motorist must attend a hearing and pass a written and skills test in order to retain driving privileges.
Age is one of the most common reasons for California DMV medical license suspensions. However, the Department of Motor Vehicles cannot a suspend a driver’s license merely because of age – a medical suspension can only occur if the driver fails the written and/or skills test administered by the DMV. One excellent way to prepare for the hearing and tests is to take private driving lessons with a special instruction permit from the DMV. Some older drivers are offended by the idea of driving lessons – after all, many have been behind the wheel since before other driver were born. However, this is often one of the most effective ways for senior drivers to retain their California licenses.
Vision problems are another common reason behind California DMV medical suspensions. However, many vision problems can be corrected and the driver’s license can be reinstated. To do so, the driver must have his or her eye doctor complete the DMV’s Driver Medical Evaluation form and pass written and skills tests. If all of these conditions are met, and the driver’s vision has improved enough to meet the DMV’s standards, the license will be reinstated.
Certain mental and physical conditions can also prompt a medical driver’s license suspension. Again, the driver’s doctor can be his or her best ally in situations such as these. In addition to completing a Driver Medical Evaluation form, a brief letter from a doctor assuring the DMV that the driver is presently able to safely operate a motor vehicle will often cause the Department of Motor Vehicles to reinstate the driver’s license.
